Terms of Service

By accessing or using callit.bar, whether as a merchant or as a customer participating in a prediction promotion, you agree to be bound by these Terms of Service. If you do not agree, do not use the service.

CallIt is a sweepstakes promotion platform that enables bars, restaurants, and retail merchants to offer free prediction games to their customers. Customers may predict the outcomes of sports events and other public events. Correct predictions are rewarded with store vouchers redeemable at the sponsoring merchant.

CallIt is not a gambling platform. No money changes hands between customers and the platform. All predictions are free to enter.

Eligibility: Open to legal residents of the United States who are 18 years of age or older at the time of entry. Void in Florida and New York for promotions with total prize value exceeding $5,000, and void where prohibited or restricted by law. Employees of CallIt and participating merchants and their immediate family members are not eligible.

How to Enter: Scan the QR code provided by the sponsoring merchant OR visit the merchant's direct URL. Select your prediction. Provide a valid phone number or email address. No payment is required. One entry per person per event.

Prediction Period: Each event has a defined prediction window. Entries must be submitted before the event begins. Late entries are not accepted.

Winner Determination: Winners are determined solely by whether their prediction matches the actual outcome of the event. Odds are derived from Polymarket public market data at the time of entry and are locked at the moment you submit your prediction. CallIt does not determine odds or outcomes.

Prizes: Winners receive a store voucher redeemable only at the sponsoring merchant location. Vouchers have no cash value, are non-transferable, and cannot be exchanged for cash. Voucher value is determined by the locked odds multiplied by the bet amount. Maximum single voucher value: $500 USD equivalent. Vouchers expire 7 days from issuance unless otherwise noted.

Approximate Retail Value (ARV): ARV of each voucher varies based on real-time market odds at time of entry. ARV ranges from $1 to $500 per winning entry. Total ARV across all events is determined by each sponsoring merchant.

Odds of Winning: Odds of winning depend on the probability of your chosen outcome occurring, as reflected in live Polymarket market data at time of entry. Odds are displayed to you before you submit your prediction.

Claiming Your Prize: Winners must present their winning screen or contact information to the sponsoring merchant's staff for verification. Staff will confirm your identity by matching your contact information. Vouchers must be claimed within 7 days of the event result.

Taxes: Winners are solely responsible for any applicable federal, state, and local taxes. As of January 2026, winnings under $2,000 from a single sponsor per year do not require a 1099-MISC filing. Winners of $2,000 or more annually from a single merchant may be required to provide tax identification information.

Disputes: All disputes will be resolved by binding arbitration in accordance with AAA Commercial Arbitration Rules. Class action waiver applies.

General Conditions: CallIt reserves the right to cancel, suspend, or modify any promotion if fraud, technical failure, or any other factor beyond CallIt's reasonable control impairs the integrity or proper functioning of the promotion. CallIt is not responsible for lost, stolen, or illegible entries.

Winner List: For a list of winners, send a self-addressed stamped envelope to hello@callit.bar within 30 days of the event conclusion.

Account: Merchants must register with a valid email and agree to these Terms. Merchants are responsible for all activity under their account.

Prediction Pool: Merchants fund a USDC prediction pool used to place real bets on Polymarket on behalf of participants. Winnings are returned 100% to the merchant's account. CallIt does not retain any portion of prediction winnings.

Monthly Fee: Plan fees are billed monthly and are non-refundable. Prediction pool balances are refundable upon cancellation (minus any pending bets).

Legal Compliance: Merchants are responsible for ensuring their promotions comply with applicable state and local laws. CallIt provides tools for compliance (AMOE, prize caps) but does not provide legal advice. Merchants in Florida or New York with promotions exceeding $5,000 total prize value must register with their respective state before launching.

Prohibited Use: Merchants may not use CallIt for cash prize promotions, promotions targeting minors, or any purpose that constitutes gambling under applicable law.

Termination: Either party may terminate the account at any time. Upon termination, any remaining prediction pool USDC balance will be returned to the merchant's provided wallet address within 14 business days.

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. CALLIT DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. CALLIT DOES NOT WARRANT THAT POLYMARKET MARKETS WILL BE AVAILABLE OR THAT ODDS WILL BE ACCURATELY TRANSMITTED.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CALLIT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, ARISING FROM YOUR USE OF THE SERVICE. CALLIT'S TOTAL LIABILITY SHALL NOT EXCEED THE FEES PAID BY YOU IN THE 3 MONTHS PRECEDING THE CLAIM.

These Terms are governed by the laws of Delaware, United States, without regard to conflict of law provisions. Any disputes shall be resolved through binding arbitration under AAA rules.

We may update these Terms at any time. Merchants will be notified via email. Continued use of the service constitutes acceptance of updated Terms.
